CONCERNING
IMPLEMENTATION DIRECTIVE OF COLLECTION SAFEGUARD MEASURES IMPORT DUTY ON THE IMPORT OF WOVEN FABRICS OF COTTON, BLEACHED AND UNBLEACHED PRODUCTS

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. that in the framework to implement provision in Regulation of the Minister of Finance No. 58/PMK.011/2011 dated March 23, 2011, concerning the Imposition of Safeguard Measures Import Duty on the Import of Woven Fabrics of Cotton, Bleached and Unbleached Products, it is necessary to regulate implementation directive.

b. that based on consideration as intended in paragraph a, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Implementation Directive of Collection Safeguard Measures Import Duty on the Import of Woven Fabrics of Cotton, Bleached and Unbleached Products.

In view of:

1. Law No. 7/1994 concerning Ratification of Agreement Establishing The World Trade Organization (Statute Book No. 57/1994, Supplement to Statute Book No. 3564);

2. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);

3. Presidential Decree No. 84/2002 concerning Efforts to Safeguard the Domestic Industry form the Impact of Import Surge (Statute Book No. 133/2002);

4. Presidential Decree No. 56/P/2010;

5. Regulation of the Minister of Finance No. 58/PMK.011/2011 dated March 23, 2011, concerning the Imposition of Safeguard Measures Import Duty on the Import of Woven Fabrics of Cotton, Bleached and Unbleached Products.

HAS DECIDED:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING IMPLEMENTATION DIRECTIVE OF COLLECTION SAFEGUARD MEASURES IMPORT DUTY ON THE IMPORT OF WOVEN FABRICS OF COTTON, BLEACHED AND UNBLEACHED PRODUCTS

Article 1

(1) On the import of woven fabrics of cotton, bleached and unbleached, are imposed Safeguard Measures Import Duty.

(2) Imported products of woven fabrics of cotton, bleached and unbleached as intended in article 1 consists of:

Article 2

Safety Measures Import Duty as intended in Article 1 is imposed for 3 (three) years with following condition:

No.; Period; The Amount of Safeguard Measures Import Duty
1.; 1st Year, one year period since stipulation date of this Regulation of the Director General.; Rp 116,800 per kilogram
2.; 2nd Year, one year period since ending date of first year period.; Rp 109,500 per kilogram
3.; 3rd Year, one year period since ending date of second year period.; Rp 102,200 per kilogram

Article 3

The Safeguard Measures Import Duty as intended in Article 1 shall be imposed on the import of woven fabric cotton, bleached and unbleached products from all countries except produced in and imported from countries as stated in Attachment to this Regulation of the Director General, which is an integral part of this Regulation of the Director General.

Article 4

(1) Imposition of Safeguard Measures Import Duty as intended in Article 1 is:

(2) In case provisions in Common Effective Preferential Tariff Schemes are not fulfilled, imposition of Safeguard Measures Import Duty on the import from countries are in international goods trading agreement schemes as intended in paragraph (1) b shall be Most Favored Nation.

Article 5

The import of woven fabrics of cotton, bleached and unbleached products from countries excepted from the imposition of Safeguard Measures Import Duty as intended in Article 3 and from countries has trading agreement with Indonesia as intended in Article 4 paragraph (1) b, importer shall submit Certificate of Origin.

Article 6

Provisions of Safeguard Measures Import Duty Tariff as intended in Article 2, shall apply to the import of goods whose import customs notification has secured registration number from the Customs Office at the port of entry since effective date of this Regulation of the Director General.

Article 7

On the imported goods subject to Safeguard Measures Import Duty should pay Import Duty and Tax on Import (PDRI) by using import customs notification, also should pay Safeguard Measures Import Duty and additional PDRI in relation with the imposition of Safeguard Measures Import Duty by using payment basic documents:

Article 8

(1) Safeguard Measures Import Duty is calculated based on customs value of Woven Fabrics of Cotton, Bleached and Unbleached products as intended in Article 1 multiplying with tariff rate of Safeguard Measures Import Duty as intended in Article 2

(2) Additional PDRI in relation with imposition of Safeguard Measures Import Duty is calculated based on percentage of PDRI tariff multiplying with Safeguard Measures Import Duty.

Article 9

Payment of Safeguard Measures Import Duty and Additional PDRI in relation with Safeguard Measures Import Duty use Customs, Excise and Tax Payment Slip (SSPCP). Account code for Safeguard Measures Import Duty uses account code for Import Duty; and Account code for additional PDRI in relation with Safeguard Measures Import Duty uses PDRI account code.

Article 10

Head of Customs Office submits monthly report of implementation of imported goods subject to Safeguard Measures Import Duty to Director General with attention to Director of Customs Techniques by using report form as stated in Attachment III of this Regulation of the Director General.

Article 11

(1) This Regulation of the Director General shall come into force since March 23, 2011.

(2) This Regulation of the Director General shall valid for 3 (three) years since effective date of this Regulation of the Director General as intended in paragraph 1.
